OFFICIAL CONTEST RULES

Backyard Broadcasting of Pennsylvania, LLC

1. Eligibility

Unless specifically stated otherwise, contestants must be eighteen (18) years of age or older to participate in any Backyard Broadcasting of Pennsylvania, LLC contest.

2. No Purchase Necessary

No purchase is necessary to enter or participate in any Backyard Broadcasting of Pennsylvania, LLC contest.

3. Entry Selection

All mail-in, fax-in, and Backyard Broadcasting App entries will be selected by random drawing.

4. Prize Awards

All prizes will be awarded to the designated winners unless otherwise stated in the specific contest rules. Cash will not be substituted for any prize.

5. Lost or Delayed Prizes

Backyard Broadcasting of Pennsylvania, LLC is not responsible for prizes that are lost or delayed due to the United States Postal Service or other shipping and delivery carriers.

6. Employee and Sponsor Eligibility

Employees and their immediate family members of Backyard Broadcasting of Pennsylvania, LLC, its affiliated agencies, and clients sponsoring a specific contest, along with those clients’ immediate family members, are not eligible to participate in or win that contest.

7. Taxes and Fees

Winners are responsible for all applicable federal, state, and local taxes, as well as any fees associated with accepting or redeeming their prizes.

8. Prize Pickup and Forfeiture

Winners have thirty (30) days from the date they win to pick up their prizes at the offices of Backyard Broadcasting of Pennsylvania, LLC, located at 1685 Four Mile Drive, Williamsport, PA 17701, unless otherwise stated in the specific contest rules.

Office hours are Monday through Friday, from 8:00 AM to 5:00 PM.

Prizes not claimed within the designated period will be forfeited, and the winner will have no further claim to the prize.

9. Promotional Consent

By accepting a prize, winners grant Backyard Broadcasting of Pennsylvania, LLC permission to use their names, photographs, voices, locations, and prize information for promotional and publicity purposes without additional compensation, except where prohibited by law.

10. Prize Restrictions

Winners may not request substitutions or changes to the dates, times, destinations, or other conditions associated with accepting or redeeming prizes awarded through Backyard Broadcasting of Pennsylvania, LLC contests, except as otherwise provided in these rules or required by applicable law.

11. Prize Values and Tax Documentation

Winners of prizes with a total reportable value of two thousand U.S. dollars ($2,000.00) or more during a calendar year may be required to complete and return an affidavit of eligibility and provide a completed IRS Form W-9, including their Social Security number or taxpayer identification number, before receiving their prizes.

Backyard Broadcasting of Pennsylvania, LLC reserves the right to request necessary tax documentation for prizes of any value to comply with applicable federal and Pennsylvania tax-reporting requirements.

Failure to provide required documentation may result in disqualification and forfeiture of the prize, subject to applicable law.

11A. Cash Prize Documentation

Winners of any cash prize may be required to provide their mailing address and Social Security number or taxpayer identification number for administrative and applicable tax-reporting purposes.

Failure to provide the required information may result in disqualification and forfeiture of the cash prize.

11B. Firearm Prize Eligibility

If a prize consists of a firearm, the winner MUST be legally eligible to possess and receive a firearm under all applicable federal and state laws and regulations.

The winner must successfully complete all required background checks and comply with all applicable legal requirements for the transfer of the firearm in Pennsylvania.

If the winner is legally ineligible, unable, or unwilling to comply with these requirements, the prize will be forfeited, and no substitute prize will be awarded.

12. Final Determination of Eligibility

Backyard Broadcasting of Pennsylvania, LLC, the parent company of WILQ, WZXR/WCXR, WOTH, WBZD, and WWPA, reserves the right to make the final determination regarding the eligibility of all contestants and winners, subject to applicable law.

13. Additional Contest Rules

Individual contests may be subject to additional rules, restrictions, eligibility requirements, or conditions established by Backyard Broadcasting of Pennsylvania, LLC management.

Any additional rules will apply to the specific contest for which they are issued.

14. Contest Decisions

All decisions made by Backyard Broadcasting of Pennsylvania, LLC and its designated contest judges regarding contest administration, eligibility, and winner selection are final, subject to applicable law.

15. Contest Rule Modifications

Backyard Broadcasting of Pennsylvania, LLC reserves the right to amend, modify, or clarify contest rules when reasonably necessary due to circumstances beyond its control, technical difficulties, errors, or other legitimate operational considerations.

Any changes to contest rules will be made in accordance with applicable federal and Pennsylvania laws and regulations. Material changes to an active contest will be communicated to participants through appropriate station channels.

No modification will unfairly disadvantage participants who have already entered a contest or retroactively alter the eligibility requirements, prize structure, or method of winner selection, except as required by law or reasonably necessary to address circumstances beyond the station’s control.

16. Broadcast and Streaming Signal Delays

Due to differences in signal transmission and delivery methods, delays may occur between a station’s over-the-air analog or HD Radio signal and its online webcast, mobile app, or other digital streaming platforms.

Listeners accessing a station through an online stream, mobile app, or other digital platform may hear contest announcements, instructions, or cues to call later than listeners receiving the station’s over-the-air broadcast signal.

As a result, listeners using delayed delivery platforms may experience a reduced opportunity to participate in or win time-sensitive contests.

Backyard Broadcasting of Pennsylvania, LLC is not responsible for delays caused by differences in signal transmission or delivery methods, to the extent permitted by applicable law.

17. Event Cancellation, Postponement, and Prize Availability

Backyard Broadcasting of Pennsylvania, LLC and its affiliated radio stations are not responsible for the cancellation, postponement, rescheduling, or modification of any concert, performance, sporting event, or other third-party event due to circumstances beyond the stations’ reasonable control.

Tickets awarded as contest prizes are subject to the terms, conditions, restrictions, and policies established by the event organizer, artist, promoter, venue, and ticket issuer.

If an event is canceled, postponed, rescheduled, or otherwise modified after tickets have been awarded or delivered to a contest winner, Backyard Broadcasting of Pennsylvania, LLC is not automatically obligated to provide replacement tickets, substitute prizes, refunds, cash equivalents, or other compensation. Any such remedy will be determined in accordance with the applicable contest rules and federal and Pennsylvania laws and regulations.

Any refunds, exchanges, replacement tickets, credits, or other remedies offered by the event organizer, promoter, venue, or ticket issuer will be subject to that party’s applicable policies. Winners may be required to contact the appropriate third party directly to pursue any available remedies.

If an event is canceled before an advertised ticket prize has been awarded or delivered, Backyard Broadcasting of Pennsylvania, LLC reserves the right to review the circumstances and determine whether an appropriate substitute prize or other remedy will be provided, consistent with applicable law and the specific contest rules.

Backyard Broadcasting of Pennsylvania, LLC does not guarantee that any third-party event will take place as scheduled and is not responsible for incidental or consequential expenses incurred by contest winners, including, but not limited to, transportation, lodging, meals, parking, or other related costs, except as required by applicable law.

Nothing in this provision limits or waives any rights or remedies that cannot lawfully be waived under applicable federal or Pennsylvania law.

18. Prize Availability and Substitution

All contest prizes are subject to availability. Backyard Broadcasting of Pennsylvania, LLC and its affiliated radio stations reserve the right to substitute a prize of equal or greater approximate retail value if an advertised prize becomes unavailable due to circumstances beyond the stations’ reasonable control, including, but not limited to, supplier shortages, sponsor nonperformance, product discontinuation, shipping delays, or other unforeseen circumstances.

If a contest sponsor, vendor, or third-party provider fails to supply an advertised prize, Backyard Broadcasting of Pennsylvania, LLC will make reasonable efforts to fulfill the prize obligation or provide an appropriate substitute, subject to applicable law.

Prize substitutions will be determined at the discretion of Backyard Broadcasting of Pennsylvania, LLC management, consistent with applicable federal and Pennsylvania laws and regulations.

Winners may not request cash payments, exchanges, or alternative prizes unless expressly permitted by the specific contest rules or required by applicable law.

If an advertised prize cannot be provided and no reasonable substitute is available, Backyard Broadcasting of Pennsylvania, LLC will review the circumstances and applicable contest rules to determine an appropriate resolution consistent with applicable law.

Nothing in this provision limits any rights or remedies that cannot lawfully be waived.
